By accessing or using Tectonic Web (the "Service"), including our website and client portal, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. The Service

Tectonic Web is a digital infrastructure agency and software development studio operated by CMS Consulting, LLC. The Service provides information about our capabilities, allows potential clients to submit inquiries, and offers a secure portal for existing clients ("Clients") to manage projects, invoices, and assets.

3. Eligibility and Intended Use

The Service is intended for use by individuals and organizations located in the United States. Access from outside the United States is permitted, but all use of the Service is governed by applicable United States laws.

4. Accounts and Client Portal

Clients may be issued credentials to access the secure Client Portal. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized access or use of your account.

5. Intellectual Property

Service Content: All rights, title, and interest in the Tectonic Web website, including design, code, and content, are owned by CMS Consulting, LLC.

Client Work Product: Intellectual property rights regarding custom software or designs created for Clients are governed by the specific Master Services Agreement (MSA) or Statement of Work (SOW) signed by both parties.

6. Acceptable Use

You agree not to:

• Use the Service for unlawful, deceptive, or fraudulent purposes.
• Attempt to reverse engineer, hack, or compromise the security of the Client Portal.
• Misuse contact forms or communication channels for spam or solicitation.

7. Limitation of Liability

To the maximum extent permitted by law, CMS Consulting, LLC shall not be liable for indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service (website or portal). Liability regarding professional services rendered is governed by the applicable client contract.

8. Termination

We may suspend or terminate your access to the Service (including the Client Portal) at any time, with or without notice, for violation of these Terms or for any reason deemed necessary to protect our infrastructure.

9. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Oregon. Any legal action arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Oregon.
